General Terms and Conditions (GTC) of Zentarix
1. Introduction
These General Terms and Conditions (GTC) govern the acquisition of domains through the platform Zentarix by Lindbergh AG (CHE-367.015.887). By using the website and purchasing a domain, the customer agrees to these terms and conditions.
Zentarix reserves the right to modify these GTC at any time. Changes also apply to existing customer relationships unless they affect essential contractual components.
2. Subject of Purchase
The subject of the purchase contract is the domain selected in the online shop. Upon receipt of payment, the transfer code will be provided within 24 hours. The domain transfer must be completed within 14 days after receiving the transfer code.
The seller (Zentarix) undertakes to take all necessary steps to ensure the successful transfer of the domain.
3. Purchase Price and Payment
The purchase price is due immediately and includes VAT. If payment is not received within 7 days, Zentarix reserves the right to withdraw from the contract.
Any costs incurred at the new registrar for domain transfer shall be borne by the buyer.
4. Buyer’s Obligations
The buyer is obliged to take all necessary actions required for the domain transfer, especially confirming the transfer request with the relevant registrar.
If the buyer does not fulfil this obligation within 14 days after receiving the transfer code, Zentarix may withdraw from the contract.
5. Right of Withdrawal
The buyer has the right to withdraw from the purchase contract without stating reasons until the transfer code has been provided.
The withdrawal period begins on the day of contract conclusion and ends upon the transmission of the transfer code.
To exercise the right of withdrawal, the buyer must send a clear declaration of withdrawal to Zentarix via email (info@zentarix.com) or postal mail (Thurgauerstrasse 117, 8152 Glattpark, Switzerland).
If the withdrawal is successful, the purchase price will be refunded within 14 days after receipt of the withdrawal declaration.
Withdrawal is excluded once the transfer code has been provided.
6. Warranty Disclaimer
The seller guarantees that he is the legal owner of the selected domain and that no warnings or court rulings related to the domain are known to him.
The buyer confirms that they have checked for potential trademark or name rights violations before purchase.
Zentarix assumes no liability for legal conflicts arising after the purchase.
7. Liability
Zentarix is liable only for intentional misconduct or gross negligence.
For simple negligence, liability is limited to the breach of essential contractual obligations (cardinal obligations).
The maximum liability amount is equal to the purchase price of the domain.
Zentarix shall not be held liable for delays or failed transfers if caused by external service providers (e.g., registrar).
8. Data Protection
Personal data is processed in accordance with applicable data protection laws.
The customer agrees to the storage and processing of their data for contract fulfilment.
Data will only be shared with third parties if necessary for contract execution.
9. Governing Law and Jurisdiction
Swiss law applies.
The exclusive place of jurisdiction is 8152 Glattpark, Switzerland, provided that a jurisdiction agreement is legally permitted.
10. Severability Clause
If individual provisions of these GTC are or become invalid, the validity of the remaining provisions remains unaffected.
The invalid provision shall be replaced by a valid provision that best reflects the economic intent.
